UK Skilled Worker Visa

Skilled Worker Visa (formerly "Tier 2 (General) Visa") What is a Tier 2 (General) Visa? You may apply for this visa if you have been offered employment by a UK Employer who has a Sponsor Licence and that employer has issued you with a Certificate of Sponsorship through the Sponsor Management System(SMS). It is a points based visa which means you will be given points for meeting the different requirements(as stated below) and if you meet the points, you will be given a visa. ​ Which countries Citizens can apply for the Tier 2 (General) Visa? Before 31st December 2020, only Non-European and Non-Swiss Citizens can apply From 1st January 2021, Citizens of any country can apply, including the European and Swiss Citizens ​ ​ What is the maintenance or savings required for the Tier 2 (General) Visa? There are two ways to satisfy this requirement: You should have at least £945 in your bank account as savings. This should be held in your bank account for at least a period of 90 days before the date of filing the application, in order to support yourself for your first month of stay in the UK. The Bank statement should be dated or the most recently dated part of the Bank statement, must be dated no earlier than 28 days before the date of application. The minimum balance throughout the 90 day period must not fall below £945. The funds can be held in any currency, anywhere in the world, please ensure that the Bank is not listed on the list of Banks whose statements cannot be verified at https://www.gov.uk/guidance/immigration-rules/immigration-rules-appendix-p-lists-of-financial-institutions If the funds are not in GBP, then use the currency converter at https://www1.oanda.com/currency/converter/ or Your employer can certify maintenance in the Certificate of Sponsorship. If your employer has certified maintenance, then on the Certificate of Sponsorship, you will see "Y" written in the field 'Certify maintenance for Migrant(and Dependants, if applicable)' ​ ​ How soon before my job start date can I apply for the Tier 2 (General) Visa? ​The Certificate of Sponsorship issued by your employer will be valid for 3 months, which means you can apply for your Tier 2 (General) visa during those 3 months. You can apply for this visa within 3 months of your start date of your job in the UK. Can I apply for the Tier 2 (General) Visa, if I am living in the UK in another category of visa? Yes, you can apply for the Tier 2 (General) visa if you are in the UK on any other category of visas such as any Tier 1 Main applicant , any Tier 2 Main applicant, Tier 4 Student visa(provided you meet certain requirements), Dependant Partner of a Tier 4, Representative of an Overseas Business, Start-up, Innovator, etc. If you are not in any of the above categories of visas, then you will have to file this visa from outside the UK, either from your Home Country or from any other country where you have a right to remain for at least 6 months or more, from the date when you attend your Biometric appointment. We have successfully filed applications for applicants who have been in the UK on other categories of visas as mentioned above. ​ ​ Can I switch or change to another type of visa while I am in the UK on the Tier 2 (General) Visa? Yes, you are able to move/switch/change to another category of UK visa such as Unmarried Partner Visa, Spouse Visa, Civil Partner Visa, etc. We have successfully switched applicants onto other category of visas in the UK to enable them to live in the UK for a longer period or permanently, if they have resigned from or lost the job with their Sponsoring Employer ​ Can I bring Dependants/Family members on Tier 2 (General) Visa? You can bring dependants to the UK with you while you are holding a UK Tier 2 (General) Visa. Your family members or dependants can apply along with you or apply separately later. Their visa will expire at the same date as yours, irrespective of when they apply. Only the following family members can apply: Husband/Wife/Partner Child under 18 years of age Additional maintenance amount of £630 per Dependant Family member will have to be shown as explained above in the Maintenance requirement question. ​ ​ What is the Cost for the Tier 2 (General) Visa? The fees are subject to change without notice, please refer to the fees tab at https://www.gov.uk/tier-2-general You will also need to pay the Immigration Health Surcharge (IHS) as part of your application, which would be calculated @ GBP 400 per year of visa applied for. You should look at the fields 'Work Start Date' and 'Work End Date' to calculate the number of years for the IHS calculation. This fees is payable per individual applying. If you application is refused for any reason, then the your IHS will be refunded to the same card you used to pay the IHS within 90 days after the date of the refusal of the application. The period of visa granted usually depends on how long your certifiate of Sponsorship is valid for. You should look at the fields 'Work Start Date' and 'Work End Date' to calculate ​the period of the visa. Usually this visa is granted for either 3 years or less or 5 years. ​ What are my rights and duties whilst living in the UK on Tier 2 (General) Visa ? You are able to work for your sponsor in the job that is described on your certificate of sponsorship You are able to take a second job (if you are working up to 20 hours a week in either a profession on the shortage occupation list (please check gov.uk website) the same profession as your main job and at the same job). Check the Shortage Occupation list at https://www.gov.uk/guidance/immigration-rules/immigration-rules-appendix-k-shortage-occupation-list You are able to take up some voluntary work You are able to study in the UK, but only if it doesn’t affect your job that you are sponsored for You are able to leave and enter the UK freely during the validity of your visa You are unable to get any kind of public funding/social assistance which is available to British Citizens/Settled people You cannot apply for a second job until you have started working for your sponsor You cannot own more than 10% of your UK Employer's shares (unless you are earning over £159,600 per year)​ ​ ​ When will I get a decision on my application for the Tier 2 (General) Visa? If you are applying from outside the UK, 70% of the time, you will get your decision within 10 business days from the date you attend your Biometric enrolment appointment. Only 30% of cases wherein the Entry Clearance Office (ECO) needs any further documents or information or wants to interview you, then the decision on your application may be delayed. You may be able to get a decision in 5 business days by paying additional fees for Priority Service. If you are applying from within the UK, 6 to 8 weeks from the date of your Biometric Enrolment Appointment - if you use the Standard Service 5 working days from the date of your Biometric Enrolment Appointment - if you use the Priority Service Within 24 hours(working days only) from the time of your Biometric Enrolment Appointment - if you use the Super Priority Service ​ What documents do I have to provide along with the application for the Tier 2 (General) Visa ? Current passport with at least one blank page to stick the Visa Vignette A bank statement showing you have at least £945 in savings held anywhere in the world, This should be held in your bank account for at least a period of 90 days before the date of filing the application (please check Appendix P of the UK Immigration Rules: ​the lists of financial institutions that do not satisfactorily verify financial statements, or whose financial statements are accepted at https://www.gov.uk/guidance/immigration-rules/immigration-rules-appendix-p-lists-of-financial-institutions Your Tuberculosis test results - Check if this applies to you at : https://www.gov.uk/tb-test-visa Valid Certificate of Sponsorship copy or at least the Certificate reference number English Language: (check https://www.gov.uk/tier-2-general/knowledge-of-english ) English Language test pass certificate – at least CEFR level B1 -- Link to book the IELTS Life Skills test at https://www.ielts.org/book-a-test/find-a-test-location ​ ​ Criminal Record Certificate (only for Specific UK Jobs) from any country you have lived in for 12 months or longer, in the last 10 years, this includes countries which you have even visited for tourism or to meet family, if the cumulative total number of days you have visited that country in the last 10 years is more than 12 months, then you will need a Criminal Record Certificate - Check if you need a Criminal Record Certificate and how to get it at https://www.gov.uk/government/publications/criminal-records-checks-for-overseas-applicants/guidance-on-the-application-process-for-criminal-records-checks-overseas Any documents which are not in English or Welsh, will need to be translated in English and you will have to submit both a copy of the original document and its certified translation ​ Can I extend my Tier 2 (General) Visa ? You can apply for any number of extensions of your visa upto a maximum stay of 6 years in the UK. After completing 5 years of stay in the UK on this visa, you and your dependants can apply for Indefinite leave to remain in the UK, if you meet the minimum income requirement, see the question on Indefinite Leave to remain below. ​ Can I qualify for Permanent Residence or Indefinite Leave to remain in the UK by being on Tier 2 (General) visa ​ Yes, you can qualify for Indefinite leave to remain in the UK after completing at least 5 years stay in the UK on the Tier 2 (General) visa. If you are not in any of the Shortage Occupations or PhD-level occupations, then you will have to meet the following minimum earnings requirement. Check Immigration Rules Appendix K: shortage occupation list (Source: UKVI ) to see if your job is in the Shortage occupation list. You should be earning at least the appropriate rate for your job/occupation as per Appendix J or GBP 35,800, whichever is higher.

UK Youth Mobility Visa - T5

Youth Mobility Visa - Tier 5. SEE EXPLANATORY VIDEO ABOVE What is a UK Youth Mobility Visa? This visa is based on the agreements between UK and certain countries allowing the Young Citizens of certain countries to experience the life in the UK by living and working in the UK. It is a points based visa which means you will be given points for meeting the different requirements(as stated below) and if you meet the points, you will be given a visa. ​ Which countries Citizens can apply for the UK Youth Mobility Visa? You should be a citizen of Australia, Canada, Japan, Mexico, New Zealand, Hong Kong or Taiwan, OR Republic of Korea, with a certificate of sponsorship from the relevant Government Department in Republic of Korea, OR a citizen of Britain under the following categories: British overseas citizen, British overseas territories citizen or British national (overseas) ​ ​ What is the maintenance or savings required for the UK Youth Mobility Visa? Financial Requirement - at least £1,890 in your bank account as savings. This should be held in your bank account for at least a period of 90 days before the date of filing the application, in order to support yourself when living in the UK. What is the Age requirement for the UK Youth Mobility Visa? You must be aged 18 or over at the time your visa is granted and be under the age of 31 on the date that you make your application(file application before 31st birthday) You cannot apply if you have children who live with you or who you are financially responsible for. You cannot apply if you have already been in the UK under the scheme or in the former ‘working holidaymaker’ category. Can I apply for the UK Youth Mobility Visa, if I am living in the UK in another category of visa? Yes, you can apply for the UK Youth Mobility visa if you are in the UK on any other category of visas such as Tier 4 Student visa, Tier 2 General Visa, Tier 2 Intra Company Transfer visa, etc. The only condition is that you will have to file this visa from outside the UK, either from your Home Country or from any other country where you have a right to remain for at least 6 months or more, from the date when you attend your Biometric appointment. It costs GBP 244 to apply for this visa, this usually increases every year around March/April, for the latest fees information please refer to the UKVI fees link at https://www.gov.uk/government/publications/visa-regulations-revised-table/home-office-immigration-and-nationality-fees-29-march-2019 You will also need to pay the Immigration Health Surcharge (IHS) as part of your application, which would be total £800 for a 2 year visa (calculated @ GBP 400 per year). You are unable to work as a professional sportsperson, doctor or dentist in training, unless you have evidence to prove that you gained your qualification in the UK You cannot take social benefits ​ ​ Where can I apply the UK Youth Mobility Visa from? You can only apply from from outside the UK​ ​ How soon can I apply for the UK Youth Mobility Visa? Global Talent Visa What is a UK Global Talent Visa? This is a UK work visa base on the individual applicant's talent in a qualifying field and being endorsed by a UK endorsing body confirming that the Applicant is either: A Recognised Leader or An Emerging Leader or An Endorsed funder, under the UK Research and Innovation ​ Which are the endorsing bodies? Your application will be reviewed by an organisation that’s related to your qualifying field, called an ‘endorsing body’. Individuals who already has a valid endorsement given under the previous UK Tier 1 (Exceptional Talent) visa rules, can use that endorsement to apply for a UK Global Talent visa. ​ If my endorsement application is rejected by the endorsing body, can I reapply? Yes, even if your application is rejected, you can still re-apply, however, you will have to pay the endorsement application fees every-time you apply. With subsequent applications after the initial application being rejected, we strongly recommend that you should always submit additional evidence of why you think you should be endorsed and highlight the additional documents that support your case. ​ What are the different stages of the Global Talent endorsement application? There are two stages for the application: Endorsement (Stage 1) Global Talent visa application (Stage 2), either from outside the UK or from within the UK, if you are currently hold a UK visa which allows in-country switching of visa category ​ To whom should I make the endorsement application? Stage 1 You should make the endorsement application to the UK Home Office (except for digital technology field, you apply directly to Tech Nation ) and you should not contact the endorsing body after submission of your endorsement application. The endorsing body will confirm their endorsement directly to the UK Home Office. When the endorsement application is successful, the UK Home Office caseworker will send the Endorsement Letter to you. ​ How long is the endorsement letter(received from Stage 1) valid for? The endorsement letter is valid for 3 months from the date of issue, hence, the Global Talent Visa application should be filed within 3 months from the date of issue of the endorsement letter. ​ How soon from my proposed date of travel to the UK, can I file the Global Talent Visa Application? The earliest date that you can file the Global Talent Visa Application is within 3 months from the date of your proposed date of travel to the UK, for example, if you plan to travel to the UK on 1st January, then the earliest date you can file the application is on 2nd October. ​ What is the duration of the Global Talent visa? In your Global Talent visa application, you can specify for how long you wish to get the visa for, you can select any period between minimum 1 year to maximum 5 years. However, depending on the number of years applied, you will have to pay the Immigration Health Surcharge which is calculated per year of visa requested. ​ Do I have to prove that I have reasonable chances of getting work in the UK? You are not required to prove that you genuinely intend to undertake and are able to undertake any work or business activity in the UK as stated in your application. ​ Once I get the endorsement from the UK endorsing body in my field of work, can the UK Home Office still refuse my application? It is a common misconception that once you get the endorsement, you will definitely get a Global Talent Visa, but that is not true. The UK Home Office caseworker who will consider your application will take into account: all the evidence that you submitted to the endorsing body and how credible the evidence is your previous education, work experience and immigration history to any country(including the UK) all your signed declarations to other UK Government departments regarding your employment history/work experience and any other activity in the UK The caseworker may request additional information and evidence from you or from your endorsing body. If you receive a request for additional documents/information, you will have to send any additional documents/information requested within 20 working days from the date of request. You may also be asked to attend an interview ( either in-person or by telephone) ​ What is the minimum English Language requirement? There is no minimum English Language ability requirement ​ Which countries Citizens can apply for the UK Global Talent Visa? You can be a citizen of any country (other than the UK) to file the UK Global Talent Visa ​ ​ What is the maintenance or savings required for the UK Global Talent Visa? There is no minimum savings or maintenance required to file the UK Global Talent Visa ​ Can I apply for the UK Global Talent Visa, while I am living in the UK in another category of visa? You can bring dependants to the UK with you while you are holding a UK Global Talent Visa. UK Work Visas Tier 1 Entrepreneur Visa (Tier 1) This category is closed for new applications. Individuals who are already have the Entrepreneur visa (Tier 1) can extend or bring their family members or apply for Indefinite leave to remain in the UK Investor Visa (Tier 1) The Tier 1 (Investor) Migrant category is designed to enable people to invest in British Stocks, Government Bonds, etc. This route is for high net worth individuals making a substantial investment in the UK Tier 1 General Extension The Home Office stopped accepting Tier 1 (General) applications made overseas from 23rdDecember 2010. Tier 1(General) closed from 6th April 2011 for new in-country applications. In-country extension of Tier 1(General) has also been stopped. Migrants already in the UK can only apply for Settlement once they qualify. Dependants can still apply to join applicants who have obtained prior entry clearance for Tier 1(General). Tier 1 Graduate Entrepreneur This route is for MBA and other UK Graduates who have been identified by Higher Education Institutions as having developed genuine and credible business ideas in Entrepreneurial Skills to extend their stay in the UK after graduation to established one or more businesses in the UK. It is also for Overseas Graduates who have been identified by the UK Trade and Investment as elite global graduate entrepreneurs to establish one or more business in the UK. Tier 1 Exceptional talent migrant The UK intends to become the natural home for highly talented individuals in film, television, animation, post-production or visual effects industry or anyone who is already internationally recognised at the highest level as world leaders in their particular field, or who have already demonstrated exceptional promise and are likely to become world leaders in their particular area of expertise. This route is for exceptionally talented individuals in the field of science, humanities, engineering and the arts, who wish to work in the UK. Tier 2 The tier 2 Visa is designed for nationals from Non-European Economic Area who have a confirmed job offer from a UK based company. Implemented on 27 November 2008, this visa category is an employer-led process with the sponsoring company applying on behalf of the candidate. Applicants for tier 2 visas must obtain a work permit before entering the country. The visa is especially designed for medium to highly skilled workers in possession of a sponsorship certificate. Tier 2 (Intra Company Transfer) Migrant Multinational employers can use this category to transfer their existing employees from outside the EEA to their UK branch for training purposes or to fill a specific vacancy that cannot be filled by a British or EEA worker. Tier 2 (General) Migrant Employers in the UK can recruit workers from outside the EEA to fill vacancies for which they cannot find a suitably qualified British or EEA worker. Tier 2 (Minister of Religion) Migrant A person whose main reason for coming to the UK is to do preaching and pastoral work, should apply under Tier 2 (Minister of Religion) Migrant Tier 2 (Sportsperson) Migrant A person who is applying as Tier 2 (Sportsperson) Migrant must be endorsed by the governing body for his sport and must also demonstrate that he/she is internationally establish at the highest level of whose employment will make a significant contribution to the development of the Sport at the highest level in the UK and that the post could not be filled by a suitable settled worker. Tier 4 The Tier 4 visa of the new point based system was introduced in March 2009 and specifically designed for foreign students who wish to come to the UK for study purposes. This visa is a direct replacement of the previous UK Student visa and places more emphasis and responsibility on the educational body catering to international students. It is the responsibility of the education providers to ensure that the international students coming to the UK to study at their institution obey all the rules and regulations of the tier 4 visa. Tier 4 (General) Student The Tier 4 (General) category is for adult students who want to come to or remain in the UK for their post 16 education. Rules where amended for students studying in the UK under Tier 4 of the point based. From 6th April 2013 if a Student is studying in the UK , the condition of this Conformation of Acceptance for Studies (CAS) has changed and he is now not allowed to study at a lower level than his CAS states. Tier 4 (Child) Student The Tier 4 (Child) Student category is for children coming to the UK to be educated between the ages of 4 and 17 years old. Children between 4 and 15 years old must be educated at independent fee paying schools. The Tier 4 Child Student cannot study at publicly funded schools with certain exceptions. Tier 5 The Tier 5 of the points based system was introduced to allow skilled workers aged 18-30 to come to the UK on a temporary basis. Under this visa tier, two groups of people can immigrate to the UK. The first category is for candidates coming to the UK to participate in the Youth Mobility Scheme, and the second are those who wish to engage in a specific job on a temporary basis.
